About these terms
llamay is made by Kosa8 Labs, which is registered in India and the
United States, called "we" and "us" here. These
terms apply to the website llamay.com, to llamay accounts, and to the
hosted service at app.llamay.com: sync, the drive, hosted models,
Studio, API keys, plans and seat licences. By using any of them you
agree to these terms. If you use them on behalf of an organisation,
you agree for it and confirm you are allowed to.
The privacy policy explains what we collect
and why, and is part of these terms.
The software
The llamay software — the engine, command line, desktop apps and
their updates — is licensed to you under the
llamay Software Licence Agreement, the LICENSE
file that comes with every copy. It governs installing and running
the software, and if it and these terms disagree about the software,
the licence wins. In short: you may run it on any number of machines
you own or control, for any purpose including commercial use; you may
not redistribute it, offer it to others as a hosted service, modify
it or reverse engineer it; and what you make with it is yours.
Running models on your own machine needs no account and is not part
of the hosted service.
Accounts
- You must be 18 or over to hold an account.
- Keep your sign-in details and API keys safe. You are responsible for what is done with your account and keys; revoke a key you think has leaked, and tell us at [email protected] if you think your account has been used without you.
- Give accurate details, and keep your email address current: it is how we reach you about your account.
Acceptable use
Do not use the website or the hosted service to:
- break the law, or help anybody else to;
- create or share material that sexually exploits children, promotes violence against people, or harasses or threatens them;
- infringe anybody's intellectual property or privacy;
- send malware, spam or phishing, or attack, probe or overload any system, ours included;
- get around plan limits, rate limits, metering or access controls, or use somebody else's account;
- resell or share access to the hosted service, or your API keys, outside your own use or your organisation's;
- use the output of a hosted model in breach of that model's own licence or use policy.
We may refuse a request, or suspend an account, that breaks these
rules or puts the service or other people at risk. Where we can, we
will tell you why first.
Your content
What you send to the hosted service and what you sync to it stays
yours, and so do the answers a hosted model gives you. You give us
only the permission we need to run the service for you: to store what
you sync, pass your messages to the model and return its answer. We
do not use your content to train models. What we keep, and for how
long, is in the privacy policy.
Models can be wrong. Check what a model says before you rely on it,
particularly for anything medical, legal, financial or safety
related.
Plans and billing
- The free plan is free, does not expire and needs no card.
- Paid plans, extra storage and credit are sold by Polar, our merchant of record. Polar takes the payment, handles tax and issues invoices, and its terms of purchase, shown at checkout, apply to the payment.
- Subscriptions are billed monthly, or yearly where a yearly price is offered, and renew automatically until you cancel.
- Prices are those shown on the pricing page and at checkout. If we change the price of a plan you are on, we will tell you before your next renewal at the new price, and you can cancel before then.
- A plan's limits — its token allowance, storage and which models it includes — are the ones the service enforces and the pricing page shows. Unused allowance does not carry over to the next period.
- Seat licences for using llamay at work are sold on the terms given when you buy them.
Cancelling and refunds
Cancel in a click from the billing portal in Settings. It takes
effect at the end of the period you have paid for. You then drop to
the free plan: nothing is deleted, your conversations keep syncing,
and the attention state already stored stays there and stays
downloadable. What stops is new state syncing up. If what you stored
comes to more than twice the free plan's room, new conversations wait
until you delete some.
Because the free plan lets you try llamay before you pay, payments
are generally non-refundable, and we do not refund partial periods.
If you were charged in error, or a paid feature does not work and we
cannot fix it, write to
[email protected] within 14
days of the charge and we will refund it; refunds are issued through
Polar. Nothing here takes away a right to cancel
or a refund that the law where you live gives you.
The hosted service
We work to keep the hosted service running, but we do not promise it
will always be available or free of errors, unless we have agreed a
service level with you in writing. It runs on Cloudflare, and an
outage there can be an outage here. We may change the service: add
or retire models, change features, or change limits. If a change
takes away something you are paying for, we will tell you in good
time, and you can cancel.
Keep your own copy of anything that matters. Your account page lets
you download everything the service holds for you at any time.
Other people's services
Sign-in is run by Clerk and payment by Polar. Hosted models run on
Cloudflare Workers AI, and many are published under their makers'
own licences. Web search uses public search services. Connectors,
model registries and providers you add yourself are run by others.
Those services are governed by their own terms, and we are not
responsible for them.
Disclaimers
The website and the hosted service are provided "as is" and "as
available". To the extent the law allows, we make no other
warranties, express or implied, including of merchantability, fitness
for a particular purpose and non-infringement. Nothing here limits a
right the law gives you as a consumer that cannot be limited.
Limitation of liability
To the extent the law allows, we are not liable for indirect,
incidental, special, consequential or exemplary losses, or for loss
of profits, revenue, data or goodwill, arising out of or in
connection with the website, the hosted service or these terms.
Our total liability to you for anything arising from them is limited
to the greater of what you paid us in the twelve months before the
claim and one hundred US dollars.
Nothing in these terms limits liability for death or personal injury
caused by negligence, for fraud, or for anything else that cannot be
limited by law.
Ending
You can stop at any time, and delete your account and everything the
service holds for you from your account page. Deleting cancels any
subscription first.
We may suspend or close an account that seriously or repeatedly
breaks these terms, or where the law requires it. Unless that would
be unlawful or put others at risk, we will tell you first and give
you time to download your data. If we ever stop offering the hosted
service altogether, we will give at least thirty days' notice and
refund any period paid for but not provided.
Sections on your content, disclaimers, limitation of liability and
law survive the end of these terms.
Changes
We may update these terms. The effective date at the top changes
when we do, and if a change is material we will tell account holders
by email before it takes effect. Using the website or the service
after that date means you accept the new terms; if you do not, you
can cancel and delete your account.
Law and disputes
These terms are governed by the laws of India, without regard to
conflict-of-law rules, and the courts of India have exclusive
jurisdiction over any dispute, unless a signed order says otherwise. If you are a consumer, you keep the protection of the
mandatory laws of the country where you live, and can bring a claim
there. Please write to us first: most things are settled faster by
an email than by anything else.
If part of these terms cannot be enforced, the rest still applies.
Not enforcing a term straight away does not mean we give it up.
